In Colorado, there’s only one way to guarantee yourself business success: open a bakery. But don’t just open any bakery, open a cake shop that specifically caters to the LGBT community. It seems that there’s a high demand for cakes celebrating occasions that go against the deeply held religious beliefs of one devout Christian baker. And apparently, there are no other bakers in the state who are willing or able to fulfill these requests.
This specific baker, Jack Smith, has found himself in court again as part of a decade-long battle over his right to exercise his religion. The latest case, Scardina v. Masterpiece Cakeshop, involves his refusal to make a blue-and-pink gender transition cake. This request was made seven years ago, yet it is still being litigated in the state Supreme Court today. It is clear that this is not about seeking a cake, but rather about targeting and persecuting this Christian baker.
During the oral arguments, Colorado Supreme Court Justice Melissa Hart displayed a stunning lack of understanding when she threw out a hypothetical situation where identical blue-and-pink cakes could be used for four different occasions. She suggested that the cake could be for a gender transition, the birthday of boy-and-girl twins, the loss of fraternal twins, or no occasion at all. But Justice Hart failed to realize that there was only one cake in question – a gender transition cake – and that it was specifically requested by a transgender activist to target and harass Jack Phillips.
Phillips’ attorney, Jake Warner, made an important point during the hearing. He stated that even though the cakes may look identical, the meaning behind them can vary greatly depending on the context. This is a crucial distinction when it comes to the compelled speech doctrine, which protects individuals from being forced to support certain forms of expression that go against their beliefs. By forcing Phillips to create a cake that celebrates a gender transition, the government is essentially compelling him to violate his freedom of mind and conscience.

This is not the first time Phillips has been dragged into court for his religious beliefs. In 2015, he made headlines when he refused to create a wedding cake for a same-sex couple. The case made it to the Supreme Court in 2018, where he ultimately won in a 7-2 ruling. Yet now, Scardina and the Colorado Civil Rights Commission continue to target Phillips in an effort to bankrupt him and force him to violate his beliefs. It’s clear that the left will stop at nothing to punish individuals who hold traditional values and refuse to conform to their ideologies.
Enough is enough already!
Jack Phillips should not have to continuously defend himself and his beliefs in court. The left needs to find a new target and leave this Christian baker alone. It’s weaponizing the American legal system plain and simple!
