DOJ Sues Virginia Over ICE Agent Safety Laws

The Justice Department is taking Virginia to court over two new state laws that affect federal law enforcement operations. The move puts Gov. Abigail Spanberger and several other state officials on the defensive just weeks after she signed the measures into law.

On May 20, Spanberger approved legislation that limits law enforcement officers from wearing facial coverings while on duty and requires them to display identifying information. A second law sets conditions on how federal officers can operate in the state. The Justice Department says both measures cross the line and interfere with federal authority.

In the DOJ’s view, the state cannot tell federal officers how to carry out their jobs, especially when those rules could expose agents to danger. The department argues that officers have faced harassment, doxing, and even violence, and that forcing them to reveal more information could put them and their families at risk.

“Governor Spanberger cannot tell Federal officers how to do their job,” said @ASGWoodward. “And she certainly cannot prohibit them from ensuring their own safety in conducting Federal law enforcement operations. Our suit today stops those unconstitutional efforts.”

The lawsuit names Virginia Attorney General Jay Jones and Fairfax County Commonwealth Attorney Steve Descano. The DOJ says the state’s mask ban is a direct attempt to regulate what federal officers can wear while doing their jobs. It also says the law could chill immigration enforcement and compromise sensitive operations.

The complaint is not just about clothing rules. It also takes aim at Virginia’s refusal to cooperate on immigration-related enforcement in some cases. That makes the legal fight broader than a simple dispute over uniforms. It is now a full-blown fight over who gets the final word when federal officers are working inside the state.
