In a press release issued on September 14th, the Department of Homeland Security (DHS) claimed that it would only use artificial intelligence (AI) in a way that is consistent with the Constitution and all other applicable laws and policies. However, the DHS’s past actions, including extensive censorship efforts in collaboration with Big Tech and media literacy organizations, raise serious concerns about the agency’s promises to operate within the bounds of the Constitution.
Secretary of Homeland Security Alejandro Mayorkas and the newly appointed Chief AI Officer, Eric Hysen, have emphasized the importance of protecting civil rights and ensuring that AI is free from discrimination. Dan Schneider, Vice President of MRC Free Speech America, criticized Mayorkas and Biden’s promises, stating, “The Constitution’s Abuser-in-Chief promises to uphold the Constitution. It would be breaking news if he meant it.” Schneider went on to highlight the importance of having a government that protects citizens’ rights rather than abusing them for partisan purposes.
Despite the DHS’s claims to uphold constitutional rights, its past actions prove otherwise. The agency has been exposed for colluding with Big Tech to censor viewpoints that it deems as “misinformation.” This includes their Orwellian Disinformation Governance Board (DGB), which sparked widespread backlash and was eventually shut down. However, the DHS continued its censorship efforts, working with private groups to censor alleged election-related “misinformation” during and after the 2020 election cycle. This censorship continued into the 2022 election cycle as well.

The agency’s new policy statements outline its supposed commitment to ensuring that AI use does not violate the Constitution. The DHS states that it will not collect, use, or disseminate data used in AI activities or make decisions based on discriminatory factors. It also claims that Americans have the right to opt out of AI use for “non-law enforcement purposes.” However, given the DHS’s past behavior, these promises are highly questionable.
MRC Free Speech America’s investigations uncovered further evidence of the DHS’s weaponization against certain groups under Biden’s administration. The Targeted Violence and Terrorism Prevention Grant Program (TVTP) has been used to target Christians, conservatives, and Republicans. This raises concerns about the agency’s intentions with AI use and whether it will be used to target certain groups or violate citizens’ rights.
During a congressional hearing in May, Chairman of the House Homeland Security Subcommittee on Oversight, Investigations, and Accountability, Dan Bishop, stated that the DGB was just “the tip of the iceberg” when it comes to the DHS’s censorship maneuvers.

In conclusion, while the DHS’s promises to uphold the Constitution and protect citizens’ rights regarding AI use may sound reassuring, its past actions speak louder than words. The agency’s extensive censorship coordination and weaponization against certain groups raise serious doubts about its ability to operate within the bounds of the Constitution. Mayorkas and Biden’s promises may be nothing more than empty rhetoric.
